One of the most notorious hurdles in delivery of timely justice in Indian Courts is STAY which is granted by judges so frequently that it has become a rule rather than an exception.
It would be expedient in the interest of delivery of timely justice to take away powers of judges to grant STAY in matters till the charges are framed in criminal cases or the issues are framed in civil cases in order to expeditiously dispose off cases/matters.
Advocates, who file false documents or make false statements should be barred from appearance in courts for or on behalf of litigants for life.
Stern warnings should be issued to judges who fail to take action as per the Rule Book against erring advocates and litigants. Strict accountability should be fixed on members of bar and bench in equal measure.
